Eligibility criteria

The applicant must be one of:

  • an individual or sole trader,
  • a company registered with the Australian Securities and Investments Commission,
  • a partnership.

The applicant has an Australian business Number (ABN) and / or Australian Company Number (ACN).

Guide to acceptable evidence

Evidence of the applicant’s business structure, including identification of executive(s) / key office bearers / senior management with the entity.

Evidence that the applicant has an Australian Business Number (ABN) and / or Australian Company Number (ACN), or an extract from a relevant register.

Copy of registration of company or business operation with Australian Securities and Investments Commission or relevant register. Other off shore business structure should contact the Lead Department.

Entity operation

This eligibility criterion applies to the following pre-qualification categories:

Eligibility criteria

The applicant has been in business for at least two years.

The applicant’s core business is construction works or construction related professional services appropriate to the pre-qualification category applied for.

Guide to acceptable evidence

List of completed projects, including details of the projects.

The Lead Department will contact at least two nominated referees to conduct a referee check that confirms that the applicant practices in the category applied for and holds the level of experience expected of a competent practitioner of that category.

Construction works categories that require registration as building practitioner

This category is related to the building industry. The building industry encompasses work for or in connection with the construction, demolition or removal of all types of buildings. Buildings include all classes of buildings under the National Construction Code, structures, temporary buildings, temporary structures and any part of a building or structure.

This eligibility criterion applies to the following pre-qualification categories:

  • Commercial refurbishment
  • Demolition
  • Fire services contractor
  • New Commercial Construction
  • New Residential Construction
  • Residential refurbishment

Eligibility criteria

A company must hold registration with the Victorian Building Authority relevant to the pre-qualification category(ies) applied for.

At least one individual who is a registered director of a company must hold registration with the Victorian Building Authority relevant to the pre-qualification category(ies) applied for.

At least one individual who is a partner within a partnership must hold registration with the Victorian Building Authority relevant to the pre-qualification category(ies) applied for.

An individual or sole trader must hold registration with the Victorian Building Authority relevant to the pre-qualification category(ies) applied for.

A copy of the certificate of registration as a building practitioner issued by the Victorian Building Authority, or an extract from the register of building practitioners maintained by the Victorian Building Authority.  The registration must relate to the category or categories applied for.

Construction services category that requires registration as an architect

This category is related to the building industry. The building industry encompasses work for or in connection with the construction, demolition or removal of all types of buildings. Buildings include all classes of buildings under the National Construction Code, structures, temporary buildings, temporary structures and any part of a building or structure.

This eligibility criterion applies to the following pre-qualification categories:

An approved company must hold registration with the Architects Registration Board of Victoria.

An approved partnership must hold registration with the Architects Registration Board of Victoria.

At least one individual who is a registered director of a company must hold registration with the Architects Registration Board of Victoria.

At least one individual who is a partner within a partnership must hold registration with the Architects Registration Board of Victoria.

An individual or sole trader must hold registration with the Architects Registration Board of Victoria.

Where the applicant is a company, the applicant must complete and execute the Construction Supplier Register Deed Poll and return the Deed Poll with their application for pre-qualification.

Where the applicant is a partnership the applicant must complete and execute the Construction Supplier Register Deed Poll and return the Deed Poll with their application for pre-qualification.

An individual or sole trader must hold registration as practising professional engineer, endorsed as a building engineer, with the Business Licensing Authority, relevant to the pre-qualification category(ies) applied for.

Where the applicant is a company, the applicant must complete and execute the Construction Supplier Register Deed Poll and return the Deed Poll with their application for pre-qualification.

A copy of the professional qualifications held by the applicant awarded by a recognised Australian tertiary institution.  The professional qualification must relate to the category(ies) applied for.

For applicants that hold professional qualifications obtained outside of Australia, recognition of prior learning issued by the relevant Australian professional organisation.
Evidence of full membership of, or eligibility for full membership of, the relevant Australian professional organisation.

Practice and experience in a pre-qualification category

This eligibility criterion applies to the following pre-qualification categories:

Eligibility criteria

The applicant practices in the category applied for, to the satisfaction of the Lead Department.

The applicant holds experience in the category applied for, to the satisfaction of the Lead Department.

The applicant has completed at least three projects of a similar size and complexity to the pre-qualification category applied for, to the satisfaction of the Lead Department.

The Lead Department will contact at least two nominated referees to conduct a referee check that confirms that the applicant practices in the category applied for and holds the level of experience expected of a competent practitioner of that category.

The referee questionnaire covers a range of performance criteria including:

  • timeliness
  • quality
  • management of the project
  • resource management
  • documentation
  • administration
  • health and safety management
  • environmental management

Commitment to Supplier Code of Conduct

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories

Eligibility criteria

The applicant has made a commitment to aspire to meet the Supplier Code of Conduct.

Insurance – minimum required

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories

Eligibility criteria

Where the applicant will provide advisory or consulting services, the applicant holds professional indemnity insurance that provides, at a minimum:

  • Claims made based policy with an amount of no less than $5 million AUD in any one claim.
  • This policy must contain a run off cover period of 7 years.

Where the applicant will undertake any construction, modification or demolition works, or will provide advisory or consulting services, the applicant holds public liability insurance that provides, at a minimum:

  • Occurrence based policy with an amount of no less than $20 million AUD in any one claim.
  • Contains a cross-liability and waiver of subrogation clause.
  • Clear definition for third party injury and property damage.

Where the applicant will manufacture, maintain or modify any products, the applicant holds product liability insurance that provides, at a minimum:

  • Occurrence made based policy with an amount of no less than $20 million AUD in any one claim. 
  • Contains a cross-liability and waiver of subrogation clause.
  • Clear definition for third party injury and property damage

Applicant has a Victorian WorkCover insurance policy or proof of self-insurance that covers all personnel engaged in the delivery of services.

Note: This insurance criterion assesses minimum levels of insurance.  If the applicant is engaged to undertake works or services, the contract may require different types of insurance, or insurance with higher values.  If this is the case, the applicant will be required to provide evidence to the party that engaged it that it holds the different or higher levels of insurance.

Occupational health and safety management

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories

Eligibility criteria

The applicant has an Occupational Health and Safety management system that meets the criteria set out in Mandatory evaluation criteria for Occupational Health and Safety management (Attachment 1 to Instruction 3.7), as determined by an assessor appointed by the Lead Department.

The applicant’s Occupational Health and Safety management system, including documentary evidence that the management system is in use, has been assessed as meeting the criteria set out in Detailed Guide on the mandatory Occupational Health and Safety management criteria by an assessor appointed by the Lead Department.

Where the applicant holds third party certification that its Occupational Health and Safety management system meets criteria 1-10 set out in Detailed Guide on the mandatory Occupational Health and Safety management criteria:

  • a copy of the third party certification, and
  • the applicant’s operations have been assessed as meeting criteria 11-12 set out in Detailed Guide on the mandatory Occupational Health and Safety management criteria by an assessor appointed by the Lead Department.

Industrial relations management

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories for works

Eligibility criteria

The applicant’s Industrial Relations management self-assessment meets the criteria set in Mandatory evaluation criteria for industrial relations management (Instruction 3.7.3(c) Attachment 2, to the satisfaction of the Lead Department.

Guide to acceptable evidence

The applicant's Industrial Relations management self-assessment (included as part of the Detailed guide on the mandatory industrial relations management criteria) has been assessed as meeting the criteria set in Mandatory evaluation criteria for industrial relations management (Instruction 3.7.3(c) Attachment 2).

Financial standing

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories for works

Eligibility criteria

The financial standing of the applicant has been assessed as acceptable, to the satisfaction of the Lead Department.

Guide to acceptable evidence

Financial statements (including profit and loss statements, balance sheets and notes to accounts) covering at a minimum the last two financial years, prepared in accordance with Australian Accounting Standards.

Where a project value is greater than $15 million is applied for, audited financial statements (including profit and loss statements, balance sheets and notes to accounts) covering at a minimum the last two financial years, prepared in accordance with Australian Accounting Standards.

Financial statements and checks with credit reference agencies are used to confirm that for the last financial year the applicant has:

  • Positive Tangible Net Worth
    Tangible Net Worth is defined as ((Total assets – intangibles) - (Total Liabilities))
  • Positive Working Capital 
    Working Capital is defined as (Current assets - Current liabilities)
  • History of paying creditors on time – the Lead department talks to trade suppliers, subcontractors and other referees to determine the payment history.  Consistently late payment is an indicator of potential financial difficulty.
  • Credit rating – a credit rating assessment may be required in certain circumstances and will be carried out by a licensed credit rating agency.
  • Current Ratio must be a minimum of 1
    Current Ratio means (Current asset / Current Liabilities)

The financial standing of the applicant has been assessed as acceptable by an assessor appointed by the Lead Department.

Maximum project limit an applicant may perform

For all works categories the maximum project value an applicant may perform is determined by considering the financial standing of the applicant and the applicant’s project history.

For all construction services categories the maximum project value an applicant may perform is determined by considering the applicant’s project history.

The Lead Department will determine the maximum project value.

For all works categories generally, the maximum project-value limit will not be higher than the highest value project completed by the applicant in the pre-qualification category applied for, provided the applicant’s financial standing can support projects of that value.

For all construction services categories generally, the maximum project-value limit will not be higher than the highest value project completed by the applicant in the pre-qualification category applied for.

This eligibility criterion applies to the following pre-qualification categories:

Eligibility criteria

For suppliers of works only: the financial standing of the applicant has been assessed as acceptable, to the satisfaction of Lead Department.

The applicant has completed at least three projects relevant to the pre-qualification category and maximum project value, to the satisfaction of the Lead Department.

Evidence as set out for practice and experience in a pre-qualification category.

Note: For pre-qualification categories for suppliers of works, the following steps may be used to gauge an applicant’s suitability and pre-qualification financial capacity:

Step 1 – The applicant must have

  • As a minimum, a current ratio of 1, and
  • Net tangible assets that are not less than 5% of the applicant’s construction related turnover.

Step 2 – The maximum financial capacity is usually based on the lesser of the following:

  • 100% of the applicant’s average previous 2 years’ construction related turnover, or
  • 10 times working capital.

In calculating the financial criteria and maximum financial capacity, assets and liabilities will be allowed where it can be demonstrated that they can be relied upon for supporting the entity in the event of default or insolvency.  Examples of these assets and liabilities may include all contingent assets, all shareholder loans and all related entity loans.

Step 3 – The maximum pre-qualification project or contract value is usually determined based on the lesser of:

  • the highest value of any successfully completed contract, and
  • the applicant’s maximum financial capacity.

Evaluation criteria for cladding rectification

Cladding and combustible cladding products have the same meaning as set out in the Minister’s declaration (Prohibition of High-Risk Cladding Products).

Fact sheets describing these products are available on the Victorian Building Authority website.

Involvement with cladding involves the installation, supply, approval, inspection, construction or design of cladding.

Note:  Eligibility of original practitioner to participate in Cladding Rectification Program.

The Cladding Rectification Program has determined that applicants involved in installing cladding will not be eligible to receive funding from Cladding Safety Victoria for rectifying cladding on a building where the applicant was the original practitioner that designed or installed the cladding, unless otherwise agreed by Cladding Safety Victoria.

Cladding disciplinary action

This eligibility criterion applies to the following pre-qualification categories:

  • All pre-qualification categories

Eligibility criteria

The applicant’s, or the applicant’s company or partnership, disciplinary action history will be considered as to whether they are appropriate suppliers for this sub-category, at the discretion of the Lead Department and agencies with an interest in this sub-category.

Eligibility criteria

The applicant’s insurance permits the applicant to undertake cladding work.

The applicant’s insurance contains an excess applicable to cladding work, considered acceptable to undertake cladding work at the discretion of the Lead Department.

Copy of insurance certificate of currency, in the name of the applicant.

Copy of insurance policy and or schedules addressing exclusions and excess.

Eligibility criteria

Applicant’s detailed work history of all cladding work, including where involvement was either of, or both, direct or indirect, will be considered as to whether the applicant is experienced and suitable to perform cladding rectification works, at the Lead Department's discretion.

Guide to acceptable evidence

List of completed and current projects that involve cladding, including details of the project.

The Lead Department will contact at least two nominated referees to conduct a referee check that confirms that the applicant practices in the category applied for and holds the level of experience expected of a competent practitioner of that category.

Report or finding from a cladding audit.

Note:  Eligibility of original practitioner to participate in Cladding Rectification Program.

The Cladding Rectification Program has determined that applicants involved in installing cladding will not be eligible to receive funding from Cladding Safety Victoria for rectifying cladding on a building where the applicant was the original practitioner that designed or installed the cladding, unless otherwise agreed by Cladding Safety Victoria.

Audited assessment at the discretion of the Victorian Building Authority and / or Cladding Safety Victoria

    The audited assessment may include, at the discretion of the Victorian Building Authority and / or Cladding Safety Victoria assessment of any of the following:

    • Building permit levy history
    • Complaints submitted to and / or information held in the Practitioner interest list maintained by Victorian Building Authority
    • Data related registration and licencing of Registered Building Practitioners by Victorian Building Authority, including company registrations and registrations of directors of companies
    • Results of inspections undertaken by the Victorian Building Authority under the Proactive Inspection Program
    • Data related to investigations and complaints held by the Domestic Disputes Resolution Victoria
    • Reports and probity checks undertaken by Cladding Safety Victoria
    • Enquiries, inspections and complaints held by the State-wide Cladding Audit

    Eligibility criteria

    The results of the audited assessment will be considered as to whether the applicant is an appropriate supplier for this sub-category, at the discretion of the Victorian Building Authority and / or Cladding Safety Victoria.
